Eyes Open: “What Is Simple Battery?”

On October 6th 2011, Mr. Tony Brown interviewed Jackson Parish NAACP President Windy Callahan and Jonesboro Mayor Leslie Thompson on the ‘Eyes Open’ Radio Show concerning the simple battery charges against the Mayor.  District Attorney Jonathan Stewart authorized the arrest of Mayor Thompson based on allegations by Councilwoman Renee Stringer that Mayor Thompson pushed her.

The Honorable Mayor Leslie Thompson was arrested Tuesday, October 4th 2011 by Jackson Parish Sheriff Andy Brown at approximately 11:00 a.m. while awaiting the outcome of a court hearing on another matter.  Mayor Thompson denies the allegations and describes his side of the story in this radio interview.

A major issue that was discussed by Mayor Thompson has to do with interpretation of the law.  While filling out the arrest paperwork, Sheriff Brown said that simple battery consists of one being touched against their will.  Mayor Thompson’s attorney Carol P. Lexing of Monroe, LA told Sheriff Brown he was incorrect, and that simple battery pertains to the intent to inflict bodily harm on an individual.  Sheriff Brown then looked to his code book, told Ms. Lexing that she was right and proceeded with the arrest of Mayor Thompson.

The Jackson Parish NAACP President Windy Callahan discussed in this radio interview how certain individuals are doing their best to railroad the Town and to have Mayor Thompson removed by any means necessary.  Radio show host Tony Brown said that the constant filing of frivolous lawsuits and charges must be addressed to the Attorney General and concluded the 20 minute segment with powerful words of wisdom and advice. UNISON PRAYER For The Town Of Jonesboro

Pastor Desiree’ Joe of Pacecetters Christian Fellowship in Jonesboro spoke briefly at a Minister’s Luncheon held this past September on a particular Unison Prayer she was led to share with the Jonesboro community.  The prayer is designed to pull down strongholds, principalities, powers and spiritual wickedness in high influential places by utilizing one of The Believer’s mightiest weapons: PRAYER.

Pastor Joe explains the importance and the indefensible effectiveness of speaking God’s own Words prayerfully and in unison against the demonic spirits which drive individuals to do things they don’t even understand themselves at times.  The Unison Prayer is an aid for like-minded Believers who wish to put a halt to the evil tide in Jonesboro (or anywhere else for that matter) at it’s root spiritual core, and who wish to bless the City of Jonesboro, her citizens, Mayor Leslie Thompson and his administration.

Thompson approximately 1 month ago.  At the end of the video, Mayor Thompson asks for pastors and ministers to speak this prayer at every Wednesday night service with their congregations. Mayor Thompson Speaks On His Arrest

Jonesboro Mayor Leslie Thompson interviewed by phone with Mr. Tony Brown on the “Eyes Open” Radio Show in Alexandria, LA from his dining room early this morning, and described his side of the events leading up to his arrest.  The mayor also discussed the actual definition of ‘simple battery’ according to his attorney Carol P. Lexing who used to serve as an assistant district attorney. A portion of the embattled mayor’s interview is included in the video here:

 

 

Mayor Thompson concluded his interview with Mr. Brown by letting it be known this is not just a Jonesboro issue but a national one, and that another application for an appeal is being made based on an unfavorable court decision just handed down by the Second Judicial District Court Judge Jennifer Clason.

The Motion To Quash issue Mayor Thompson’s attorneys Carol P. Lexing and Louis G. Scott were dealing with in court the day Thompson was arrested had to do with the District Attorney Jonathan Stewart’s decision to allow Jackson Parish Sheriff Andy Brown’s investigative team to raid Mayor Thompson’s offices back in March of this year with no crime or probable cause being clearly defined.

At the close of the radio show interview with Tony Brown, Mayor Thompson remarked as follows:

“It’s a cry out on my part for all the decent people. The outrage that our community is experiencing right now is by no means a stretch of the imagination in only the Black community.  Both Black and White alike are tired of what we’ve been having to go through.  We are really, really tired, and we appreciate your show in that we can get the word out so that folk just don’t see this as a Jonesboro problem.

This is not a Jonesboro problem, this is not a Jackson Parish problem; this is a problem that we’re having not only in the State of Louisiana but all over the country.  And now that the Court of Appeals has opted to hear our case, that is a major victory for us. (See article here.) It says that they found appellate merit in what we submitted. We’re looking forward to them overturning the previous deal, and I want folk to know about our day in court the other day, while they ruled against us, our claim was against the Sheriff (Andy Brown) and the District Attorney (Jonathan Stewart) in that they didn’t have probable cause to raid my office.

My lawyer asked over and over ‘What was the crime?’ and because nobody could articulate a crime, then this too goes to the appellate court and we’re asking is it okay for mayor’s offices, Black elected officials or just your personal home to be raided without any crime specifically being identified with the hope of being able to put something together based on what you find?”

Mr. Tony Brown vowed to assist in any way possible and suggested that the onslaught of frivolous lawsuits and criminal charges be dealt with in a class action manner.  The Jackson Parish NAACP President Windy Callahan also interviewed on the Eyes Open Radio Show this morning and said that Stringer is part of a group that is trying to remove the mayor by any means necessary.

Ms. Callahan said, “Let me be clear on this:  The mayor will be there until the citizens of Jonesboro declare that they no longer want him to serve in that capacity.”  She also encouraged listeners to participate in the drive to increase NAACP membership and reminded them that their voices can be heard at the polls, but only if they are registered to vote.

2nd Circuit Court Accepts Jonesboro’s Request For Appeal

Appeal Application Accepted

In the matter of Essmeier vs. The Town of Jonesboro (case # 32584) Louisiana’s Second Circuit Court of Appeal has decided to accept the Writ Application filed by Attorneys Louis G. Scott and Carol P. Lexing of Monroe, LA on behalf of Jonesboro Mayor Leslie Thompson and Council Members LaStevic Cottonham, Devin Flowers and Charla Thompson-Melton.

The application for appeal was filed on September 16th, 2011 in staunch objection to 2nd Judicial District Judge Jimmy Teat’s ruling for the plaintiffs back on August 17, 2011.  Many Jonesboro citizens believe Judge Teat’s ruling to be quite biased, controversial and some said “provocative.”

While the matter is most likely going to take many months to be decided at this appellate level —in what very well could turn out to be a landmark case, the supporters of Mayor Thompson’s administration and the supporters of the Council Members who were sued are comforted to know that this request for justice was not swatted down like it could have been, and that the arguments presented by Attorneys Lexing and Scott therein were deemed worthy of the Second Circuit Court of Appeal’s attention and considerations.

Jonesboro Mayor Leslie Thompson Arrested

Attorneys Carol P. Lexing and Louis G. Scott of Monroe, LA were about to present their arguments in the Jackson Parish Courtroom to 2nd Judicial District Judge Jennifer Clason as to why they believed the raid on Jonesboro City Hall by Sheriff Andy Brown’s investigation team back in March of this year was unjustified, when they found themselves in the midst of a more immediate and pressing matter: the surprise arrest of their client, the Honorable Mayor Leslie C. Thompson.

The complainant, Jonesboro Councilwoman Renee Stringer was seen at the Jackson Parish Courthouse while Mayor Thompson was in court, and shortly afterward Jackson Parish Sheriff Andy Brown informed Mayor Thompson of District Attorney Jonathan Stewart’s decision to arrest him while Thompson was awaiting the outcome of the above stated unrelated hearing.

Mayor Thompson immediately left the courtroom with Sheriff Brown upon learning about the simple battery charge filed against him.  Attorney Scott proceeded with the Motion To Quash issue at hand (which was later denied), while Attorney Lexing assisted Mayor Thompson in Sheriff Brown’s office.

The allegations by Stringer against Mayor Thompson are reported to have taken place in the presence of many witnesses at the Jackson Parish Library’s first “Concert-In-The-Park” event held this past Saturday afternoon on October 1st, 2011 at the Jonesboro Veteran’s Park.

Mayor Thompson welcomed the crowd and introduced the first band at approximately 2:00 p.m. shortly before the alleged actions took place. Stringer wrote in her initial hand written complaint that Mayor Thompson pushed her “almost out of the chair” after asking him to leave her alone 3 times.

The Mayor of Jonesboro was released on a $500 bond immediately after his arrest and denies the allegations against him.  The arraignment is scheduled for Tuesday, November 8, 2011.
